Miami investor let glam girlfriend live rent-free in $6.2M condo — which someone else owned: lawsuit

A glamorous Miami anesthesiologist must have thought she hit the jackpot when her generous boyfriend gave her a luxury $6.2 million apartment to live in.

The only problem was that it turns out he never owned it.

Fatma Haiderzad lived in the luxury three-bedroom and four-bathroom condo at the Turnberry Ocean Club in Sunny Isles, Miami, from 2022 to 2024.

Investment advisor Tyron Birkmeir arranged for her to move in after brokering the sale on behalf of a foreign investor, court documents claim.

While Haiderzad, 39, lived in the apartment, Birkmeir, 56, allegedly took membership of the social and golf clubs that came with the condo, worth $115,000-a-year, for himself, rather than giving them to his client.

Sources say the pair first met outside a luxury hotel in Miami several years ago.

A source claimed Birkmeir “gets by on personality and ambition, rather than talent.”

His alleged duplicitous condo involvement comes despite the Swiss national claiming to have $5 billion in assets under control of his company, Lurra Capital.

Birkmeir, who was born in South Africa, has previously worked at banks in London, Cyprus and Zurich, where Lurra Capital is headquartered.

The company describes itself online as “an invitation-only global investment firm” and is a backer of the Hexagon Cup, a celebrity-backed Padel tournament where team owners include Eva Longoria and tennis player Andy Murray.

The company also bought a $42 million condo building in Miami in 2022.

Haiderzad, 39, from Missouri, has been a registered nurse since 2010 and qualified as an anesthetist around 2015, moving to Chicago and then Miami around 2020.

In addition to her medical work, she is listed on some websites as a Senior Vice President at Lurra Capital.

The condo lawsuit is brought by Sphere Mia, a company owned by the foreign investor which actually bought the condo, and claims Birkmeir misrepresented it was he who bought the property for himself, rather than the Sphere.

The defendants — Haiderzad, real estate firm BRG International and its CEO Matias Alem — are accused of breach of statutory duty and fraudulent concealment among other charges.

Sphere claim that Birkmeir, who isn’t a party in the lawsuit, BRG and Alem, “grossly inflated” the price of the condo so the latter two got a higher commission.

Rather than the usual three percent, the higher price meant they got six percent.

In December last year, a unit one floor above the condo sold for $5.7 million — $500,000 less than the $6.2 million paid by Sphere, after years of increasing prices in the property market.

Sources told The Post Sphere was approached by Birkmeir to buy the property as an investment and that they trusted him, so did not question the valuation.

However, at some point Sphere discovered not only the price been inflated, but also Haiderzad had been living in the condo without their knowledge.

The lawsuit states: “After the Turnberry Condo was purchased by Sphere Mia, instead of renting the property to offset costs and/or generate recurring revenue, Birkmeir arranged for defendant Haiderzad to occupy the apartment on a full-time basis for two years, making no rent payments to Sphere Mia as compensation for the fair value of the use of the property.

“Plaintiff seeks to recover from Haiderzad damages in an amount equal to the reasonable value of rent she should have paid during the two years she occupied the luxury condominium.”

Attempts by The Post to reach Haiderzad were unsuccessful. A lawyer for Alem told The Post: “There is no truth or merit to the allegations directed to my clients, BRG International LLC and Matias Alem.”

Birkmeir is said to have paid “expenses and maintenance associated with the unit,” according to the lawsuit.

Alem’s lawyers have also filed to dismiss the suit, saying it does not involve them, however, it currently remains active. They say a previous version of the lawsuit was dismissed.

The motion to dismiss states: “Plaintiff has failed to provide even a scintilla of evidence to show how Defendant Alem was involved in the transaction … Plaintiff is unable to show how these Defendants breached any supposed duties owed to Plaintiff or fraudulently concealed any information during the transaction, largely because Plaintiff was being represented by Birkmeir himself as their Chief Executive Officer.”

The motion also points out the small print in an amendment to the purchase agreement, which says Birkmeir was to be named the recipient of one-year of golf membership at the club.
