Sean “Diddy” Combs is set to be sentenced in the fall on prostitution charges after lawyers on both sides agreed on the date for the hip-hop mogul’s day of reckoning.
Combs defense attorney Marc Agnifilo filed a letter in Manhattan federal court Tuesday afternoon notifying Judge Arun Subramanian of the Oct. 3 date lawyers from both sides landed on.
Roughly an hour later, the judge signed off on the date — which was the one he originally proposed last week when the trial concluded. Agnifilo had asked for a rushed date but ultimately settled on Oct. 3 after coordinating with prosecutors and the federal Probation Office.
The Bad Boy Records founder’s day of reckoning will be three months after he was convicted by a jury of two counts of transportation to engage in prostitution.
Combs, 55, faces up to 20 years in prison on both counts but is likely to receive far less time under federal sentencing guidelines that take into account a defendant’s criminal history and other factors.
He is more likely to face somewhere between 15 months and five years — the range that both sides will eventually haggle over.
The “I’ll Be Missing You” rapper was acquitted on the top three charges in the case — two sex-trafficking counts and one racketeering count — after a two-month jury trial that featured sensational testimony from 34 witnesses about Combs’ penchant for “freak-off” sex-marathons.
Combs’ ex-longtime girlfriend Cassie Ventura and another former gal pal, who testified anonymously, both told jurors about how the Sean John fashion founder got them high on drugs and then forced them to have sex with male escorts during baby oil doused sex-sessions that sometimes lasted for days.
They alleged that Combs watched, pleasured himself and filmed the romps — and sometimes after threatened to release the footage to pressure the women to continue partaking in his staged fantasies.
Combs — who has maintained his innocence — has been behind bars since his September arrest.
The judge Wednesday denied Combs’ bid to be released on the grounds he was acquitted of the most serious charges in the case. Subramanian said Combs posed a danger to the community considering copious testimony about his violent temper.
The lawyers attended a brief telephone conference Tuesday afternoon — which Combs and the judge were not present for — confirming the date before the judge’s deputy said Submaranian would respond in writing to their letter, which he did shortly after.
