Patrick Clancy is “grateful to the Court and to the jurors for their hard work, their commitment, and their perseverance,” his attorney David Meier said in a statement obtained by CBS Boston.

“The loss of Patrick’s children is something from which he will never recover and from which there will never be closure,” the statement read.

“The prospect of reliving this tragedy through another trial is extraordinarily painful — for Patrick, for his family, and for all us.”

Following five weeks of testimony and seven days of deliberation, the jury informed Judge William Sullivan that “with a heavy heart” they were deadlocked for a third time.

Clancy’s defense attorney Kevin Reddington revealed that one male holdout juror was preventing the group from reaching a unanimous verdict.

The judge was ready to declare a mistrial when Clancy’s lawyer dramatically begged him to hold off so he could file an emergency appeal to stop the decision.

Reddington was given a one-hour Hail Mary to appeal to the state’s highest court but his last-ditch bid was ultimately struck down and a mistrial was declared.

Prosecutors remained mum following the decision about whether they will try the case a second time, negotiate a plea deal with Clancy, downgrade the charges, or drop them all together.

The judge said a new trial could start as soon as this fall.

Clancy’s ex-husband has not been spotted at the Plymouth, Mass. courthouse since he testified at the beginning of the grueling seven-week trial on July 27.

Patrick told the 12-person panel that his ex-wife repeatedly sought help for her worsening mental state in the lead up to the killings and hauntingly recalled finding his then-wife in the backyard after a suicide attempt after she strangled her kids.

During his testimony, the jury heard a harrowing 911 call from Jan. 24, 2023, where Patrick could be heard screaming, “She killed the kids.”

Clancy’s ex-husband appears to have remained some 200 miles away from the sensational trial since he took the stand — and has been spotted around New York City where he lives with his wife, infertility specialist Rachel Danis.

Earlier this week, Patrick was snapped smiling ear-to-ear with his new wife in the Big Apple as his former spouse awaited a verdict in her grueling, high-profile murder trial.
