The ongoing deliberate criminalization of Tina Peters for exposing the methods of computerized election theft will face scrutiny this week in the Colorado Court of Appeals. - Federal Immunity / Supremacy Clause
As a federally defined “officer of election,” Peters acted to preserve federally protected election records. The State lacked authority to criminalize conduct taken to comply with federal law. The trial court wrongly denied immunity and failed to properly adjudicate it.
2. Insufficient Evidence
The State failed to prove essential elements—intent, deception, conspiracy, or personal gain. On the trial record, no rational jury could lawfully convict.
3. Denial of Due Process (Including Juror Bias)
Peters was denied a fair trial: the court excluded intent evidence, barred proof of election-record destruction and witness bias, refused proper jury instructions on execution of public duty and immunity, allowed misleading prosecution arguments, and refused to investigate credible allegations of a biased juror, undermining the verdict’s integrity.
4. Unconstitutional Sentencing
The nine-year prison sentence for nonviolent conduct is grossly disproportionate, punished protected speech, and reflects arbitrary sentencing—violating the First, Eighth, and Fourteenth Amendments.
5. Pardon / Jurisdiction
If the court has not ruled on the pending jurisdictional motion beforehand, the judges may also address the legal effect of the Presidential Pardon and its impact on jurisdiction and continued proceedings.
Bottom line: The appeal challenges a prosecution that criminalized lawful official conduct, denied a fair trial—including by ignoring juror bias—and imposed an extreme sentence inconsistent with constitutional limits.
Simultaneously, Governor Polis recently began to hint at possible clemency regarding Tina’s situation, and referred to her 9 year prison sentence as ‘Harsh’. This isn’t the first time that Governor Polis has shown some strength and gone against the “Deep State Grain Narrative”. The first major time was during the ‘Plannedemic’ when he took a more practical approach to Mask wearing than most other Blue States. The second major time was when he surprisingly praised President Trump for choosing RFK Jr. to head HHS.
While these two circumstances drew criticism from Deep State operatives who despise anything that President Trump stands for, those reactions were small in comparison to the self-serving reaction of the outspoken EVIL Colorado Secretary of State, Jena Griswold. Griswold strongly opposes any suggestion for clemency because “she believes Tina has undermined confidence in elections, and must face accountability for her actions”. What Griswold should have said is “Tina exposed the way we rig elections, that we previously had the people fooled about”.

How can we forget how Griswold used the inadvertent disclosure of one expired election password in a blurred video (that Tina never authorized the release of) to create a firestorm for unjustly removing Tina from her elected office by Judge Valerie Jo Robinson. That removal began the long road of persecution, prosecution and imprisonment of the person, Tina Peters, who exposed Griswold’s actions after the 2020 election.
We also remember how Griswold manufactured a case in Colorado to have President Trump removed from the 2024 ballot there. Had she been successful, it would have been the formula to multiply nationwide by willing parties to eliminate his candidacy in the 2024 election. Her insurgent actions were so extreme on that scheme, the Supreme Court annihilated her plan with a 9-0 decision arguing President Trump was to remain on the ballot in Colorado.
Contrast that one blurred expired password situation in a video, to Griswold being responsible for the posting of over 650 ACTIVE election passwords on a hidden tab on your SOS website, so bad actors anywhere in the world could gain access to how to manipulate the 2024 Presidential election. This is just the tip of the iceberg of Griswold’s traitorous actions. It’s no wonder she’s scared of a free Tina Peters. Her prison sentence should be 650 X Tina’s 9 year sentence.
Logically, the ramifications of a free Tina likely seem enormous to the Deep State and Jena Griswold. However, with the capture of Maduro, the blowback from this point forward is accelerating into a much larger problem for all complicit in election fraud. Governor Polis proactively getting in front of this situation is a wise thing for him to do, despite the effect it’s having on Griswold and her Deep State handlers. In 2020, the tools of a manufactured pandemic worked in concert with the unaccountable mail-in ballot system, resulting in an approximate 18+% reduction in polling locations.
