It’s a kidney she can’t refuse.
John Gotti’s grandson Friday scored a two-month delay on his surrender date to serve a 15-month stint in lockup for a million-dollar COVID scam — so long as he donates a kidney to his ailing mom, Victoria Gotti.
Carmine Agnello, 39, was set to land behind bars Monday after pleading guilty in 2024 to swiping $1.1 million in relief funds earmarked for struggling businesses and using the cash to invest in cryptocurrency.
But the Teflon Don’s grandson can instead report to the pokey Sept. 18 if he undergoes the transplant procedure as scheduled Aug. 3 to try to save his mother, said Judge Nusrat Choudhury.
“Please convey to Mr. Agnello and his mother that I hope they have a successful procedure,” the judge said during a virtual telephone conference in the Brooklyn federal court case.
If Agnello does not go through with the surgery, he’s due in prison by Aug. 10, the judge ruled.
The con brought up his 63-year-old mother’s end-stage renal disease months ago as he lobbied in vain to get a no-jail sweetheart deal.
Victoria Gotti, John Gotti’s daughter and the star of 2004 reality TV show, “Growing Up Gotti,” wrote to the judge in advance of her son’s April sentencing hearing, “He is giving me the GIFT OF LIFE.”
Federal prosecutors with the Brooklyn US Attorney’s Office repeatedly countered that Agnello could give up the kidney behind bars and that the situation did not warrant a break on prison time.
Agnello did not attend Friday’s virtual conference. His lawyer, Robert Beltrani, appeared on his behalf. Members of the press were allowed to call in.
The convicted fraudster also has been ordered to pony up $1.2 million in restitution for skimming Economic Injury Disaster Loans from the Small Business Administration that were meant to help companies bounce back from the pandemic shutdown.
Agnello grew up in the shadow of the mob, with 15 relatives, including his famous granddad, spending time in prison, he detailed in court papers.
He was famously hurled into the spotlight as a kid in his mom’s hit reality show.
John Gotti was a notoriously ruthless Gambino crime family boss in New York City for decades after his rise to power in 1986. He was convicted of racketeering in 1992 and died behind bars in 2002 after being diagnosed with throat cancer.
